Open Source Compliance – From Risk Mitigation to Competitive Advantage, Tim Yeaton, CEO, Black Duck Software

Open source, and its collaborative development model, has produced a renaissance in software development – driving global business value via accelerating innovation.  Today’s more than one million open source projects are projected to more than double by the end of 2014.   Traditional IT barriers to OSS adoption – concerns about quality, security, support – are falling away rapidly. At the same time, the open source process is evolving rapidly, producing innovation at an unprecedented rate.  Proof of open source’s importance can be seen in many of today’s most significant technology trends, driven by open source methods and technologies: mobile, cloud, big data, social media.

In this presentation, Tim Yeaton will discuss the evolution of Open Source management, reviewing how the consumption and management of open source has evolved from one focused on mitigating legal, compliance and operational risk to how the combination of open source methods and technologies can be used for competitive advantage, and is even changing entire industries.  Key areas Tim will explore include:

  • Global open source trends - the rapid growth of software projects, latest issues on OSS license and changes in industry adoption:  Gov’t, Healthcare, Financial Services, Media
  • How open source technologies and collaborative methods –  “social creativity” – is changing software development within individual organizations
  • How open source and collaboration are changing the competitive dynamics of entire industries

Understanding the Kernel Community - The Fundamental of License Compliance, Greg Kroah-Hartman, Fellow, The Linux Foundation
"Open Source License Compliance" is essentially meaning that companies need to comply with the requested terms of the original authors of the software  (=Community developers) . Thus it makes sense to have better understanding on what motivate open source developers to write codes and how those developers work together in the "Community."
In this talk, Greg Kroah-Hartman will be talking about the Linux Kernel Community. He will be answering a key questions such as who they are and why they come together to collaboratively write codes, and above all, how the Kernel Community works.
He will also touch upon why it makes more sense for the companies to work with the Community.Closed (Forked) Kernel modules tend to be illegal, unworkable, and immoral. Working closely with the community should avoid these issues.

SPDX Open Source Tooling: Integrating with Software Development Build Processes, Matt Germonprez, Associate Professor, University of Nebrask at Omaha
The discovery and expression of open source software licensing information is a becoming critical concern in many corporate software development projects. In this presentation, we demonstrate how open source SPDX tooling can be used to integrate with existing software build processes, in the expression of package and file level licensing information. In particular, the presentation will illustrate how SPDX documents are produced in conjunction with the Yocto Project build process and discuss ways that such production could be generalized to other build environments. Following the production of SPDX documents, we will discuss methods for viewing, consuming, and sharing the documents using additional SPDX open source tools.

Adopting SPDX in Embedded Space: Why and How?, Suhyun Kim, Senior Engineer, Samsung Electronics
The Software Package Data eXchange(SPDX) specification is a standard format for communicating the software components, licenses and copyrights. It is hosted at the Linux Foundation whose goal is to facilitate compliance with free/open source software licenses and the exchange of such information between companies. As a company that uses free/open source software in various products, we has tried to adopt SPDX in our open source governance system. In this talk, we will discuss benefits of the using SPDX in embedded system based on our experience. The first is focused on reducing the cost of verifying open source licenses(auto-identify component), and the second is focused on the implementation of the license note web system.

License compliance from the trenches, Armijn Hemel, Owner, Tjaldur Software Governance Solutions
There is a famous saying: "in theory, theory and practice are the same. In practice they are not."
This is unfortunately very true of compliance in the embedded Linux/consumer electronics supply chain. Even though license compliance should be trivial if all the right procedures are followed often it is a complete mess due to lots of reasons, ranging from sheer incompetence, to downright confusion, hostility and fear of losing intellectual property. In this talk I want to highlight a few of the common problems I have found in the last 8.5 years and discuss possible measures that we as a whole industry can take to make it easier for everyone.

Soft power: Defusing compliance through dialogue, Karsten Gerloff, President, The Free Software Foundation Europe
Compliance has traditionally been one of the challenges
for established technology companies entering the Free
Software space. While the rules themselves are quite
clear, there exists considerable complexity. Companies
which ignored the licenses and the social contract
underlying them have had to face considerable headwinds.
The Free Software community takes compliance very
seriously. While copyright holders will work with
infringers to reach a resolution, companies without
established processes in this area may find the situation
challenging.

A different approach was urgently needed. Since 2007, the Free
Software Foundation Europe operates the Legal Network, an
international group of experts on Free Software's legal and licensing
aspects. This network has established itself as the primary platform
to facilitate a lively informal dialogue between industry and
community. It provides a forum to quickly resolve conflicts before
they escalate, and drives the development of best practices around the
legal aspects of Free Software.

Standardized Contributor Agreements – What is needed to develop a legal and technical infrastructure for FLOSS projects to efficiently manage and structure their Intellectual Property rights?, Dr. Catharina Maracke, Associate Professor, Keio University
The proposed session will give an overview of the current status on standardized copyright terms for contributor agreements.
It will discuss challenges and opportunities for standardization efforts and explore the role of defensive patent licensing. In addition, the presentation will suggest ideas for a better infrastructure to reduce friction and transaction costs and to move rights between developers, projects and end-users: One important topic to be presented in this context is the possibility to set up a network of intermediaries, which allows trustworthy third parties to mediate rights between developers and projects and help reduce friction in reviewing and negotiating terms of copyright agreements. As a starting point for further discussion, details and usage of the “Fiduciary License Agreement”(http://fsfe.org/activities/ftf/fla.en.html) will be presented to understand advantages and potential pitfalls of such a model.

Open Source Program at Sony Mobile: Key Principles and Challenges, Johan Nielsen, Open Source Officer, Sony Mobile
Most organizations struggle to implement an open source program that not only provides structure and governance to secure compliance at the onset, but can scale with the organization as its open source maturity grows. Sony Mobile is no exception.

In this talk we will discuss the key principles of our open source program at Sony Mobile. We will have a look at the program’s governance, key functions, and processes as well as the challenges we have faced, and are facing.
